Yaralla Fitness Centre – Terms and Conditions of Membership – updated January 2023

General Conditions of entry – Yaralla fitness centre

To assist us in maintaining a safe and comfortable environment for all members and staff, you are required to abide by the following conditions. Failure to abide by these conditions may result in the suspension or termination of your membership.

Acknowledgement by the member of risks, injury, obligations, and liability release

  • I acknowledge that participating in any activity or using any equipment in Yaralla Fitness Centre’s is entirely at my own risk. I acknowledge that whilst participating in such activity I may be injured or other persons participating in such activity may cause me injury. I agree that Yaralla Fitness Centre’s, Yaralla Sports Club inc., employees and their servants or agents shall not be liable for any death or personal injury occurring to myself upon any Club premises or as a result of the use of facilities and/or equipment provided by Yaralla, except to the extent that such death or personal injury arises from the gross negligence of Yaralla.
  • I understand and acknowledge that Yaralla purchases or leases the equipment from a third party and therefore does not manufacture any of the fitness or other equipment used in the Clubs. Yaralla cannot be held liable for defective products or equipment, except to the extent to which the law holds them liable. In the provision of services, other than recreational services, Yaralla will use due care and skill and any materials supplied in the connection with those services will be reasonably fit for the purpose for which they are supplied.
  • I acknowledge that my personal property may be lost or damaged and agree that Yaralla and employees are not liable to me for any personal property that is damaged, lost, or stolen while in or around the Clubs, including, but not limited to property left in lockers, except where caused by the gross negligence of Yaralla.
  • If I cause damage, vandalise, or steal to/from the Fitness Centre’s, its facilities, services, products, or equipment by my own wilful act and/or negligence, I am liable to Yaralla for its cost of repair or replacement, CCTV can be used as evidence for tracking purposes.
  • I am aware that during non-staffed hours there will be no supervision or assistance in the case of injury to myself, become unconscious; suffer a stroke or heart attack. I understand that there may be no one to respond to this emergency and this facility has no duty to provide this assistance to me. Even though YFC facilities are equipped with surveillance cameras and panic response system, it is likely that should I require immediate assistance, none will be provided. Yaralla Fitness Centre highly recommends that I have a workout partner accompany me while at the club, but I understand this is my choice.

 

Membership/access card

  • All members must present their membership card upon entry to the Club at every visit. If you attend the Club without your access card, we may refuse your entry. New membership cards can be purchased at YFC reception due to loss or damage to gain entry.
  • You must scan your membership card and register your attendance for safety, security, and insurance purposes.
  • Your access card is our property; you cannot lend your card or allow anyone else to use it.
  • Any misuse of your membership card may result in immediate membership suspension or termination, at the discretion of the Club Manager.

Suitable CLOTHING and personal belongings

  • All members and guests must wear suitable clothes and enclosed sports shoes in all exercise areas. We do not allow clothes with offensive images, inappropriate advertising, work boots, and/or hi-vis uniforms.
  • As a safety measure, bags and personal belongings are not to be left on the gym floor. All bags and personal belongings must be left on provided bag rack and/or pigeonholes.

24-hour access

  • 24-hour access is permitted to 16 years and over only. Members aged 12-15 years old, have access between the hours of 5am and 8pm only, accompanied by a parent and/or guardian.

 

Use of equipment

  • Clean towels must be used at all times, and on all equipment to ensure cleanliness of the facility. Cleaning stations are provided, members are expected to clean equipment after use.
  • You are required to return equipment to their original state when you have finished.
  • For the safety of you and others, please follow all equipment operating and safety instructions on the equipment.

 

Disclosure of your physical condition

Your further warrant and represent that you will not use the Fitness Business or any of our facilities, services, or products whilst you are suffering from any infectious or contagious illness, disease, or other ailment, or whilst you are suffering from any physical ailment such as, open cut or sores, and minor infections, where there is a risk to other members and guests.

Refusal of entry, termination, and suspension of MEMBERSHIP

Management reserves the right to terminate any membership agreement if the member does not comply with the Terms and Conditions of the membership. We can refuse entry to the Fitness Centre’s, cancel your membership, or terminate the contract without notice for inappropriate, threatening, or harassing behaviour, damaging equipment or facilities, or use of illegal or performance enhancing drugs in the facility.

Photo release & CCTV

I consent to Yaralla Fitness Centre using or reproducing photographs for the purpose of advertising, media publicity, publication, web display, or any other purpose in whole or in part. I waive any interest in the copyright to the photograph(s) now or at any future time and do not expect to receive any payment or consideration in respect of them. I grant release to Yaralla Fitness Centre, its employees, and agents from any liability (including consequential loss) connected with the publication, reproduction, release, or other use of these materials. I understand the club is under 24-hour surveillance for security purposes only and hold no privacy claims against Yaralla Fitness Centre.

 

Membership types

Direct debit memberships

A joining fee of $99 and a $15 establishment fee applies to all new Direct Debit members. The joining fee entitles the member to renew or restart a membership with a 12-month period following the expiration of their membership.

All memberships are subject to a 48-hour cooling off period. It is at the discretion of the Cub Manager as to costs incurred, and any refunds applicable, with cancelling a membership during this period. The membership is ongoing, unless specified otherwise on the Debit Success contract, and will continue until cancellation by the member, Yaralla Fitness Centre, or Debit Success.

                Cancellations

  • Memberships cannot be cancelled within the agreed minimum term of the agreement, stated on the Debit Success contract.
  • 1 month written cancellation notice in required after the fulfilment of the agreed minimum term. Memberships that are cancelled during the minimum agreed term will be cancelled after the minimum term has been fulfilled.
  • You may terminate your membership before the fulfilment of the agreed minimum term upon presentation of a medical certificate only and is at the discretion of the Club Manager.
  • Cancellations will only be accepted when submitted via a website form, email to fitnessreception@yaralla.com.au or in person.
  • Payments that fall within the 30 days are to be paid, access to the club will continue during this time. Any reversals, catchups, cancellation fees or changes to the instalment amounts or collection dates may affect the accuracy of the 30 day projection.
  • Membership payments must be up to date with zero fees owing.

Suspensions

  • Memberships can be suspended for a minimum of 1 month and maximum of 3 months over one calendar year.
  • Membership payments must be up to date with zero fees owing.
  • Members must give a minimum 7 days’ notice to apply a suspension, however, immediate suspension request may be authorised at the discretion of staff.
  • Payments will automatically restart at the end of the suspension and is not the responsibility of YFC staff to contact the member.
  • You may extend your membership suspension past the maximum of 3 months at the presentation of a medical certificate only and is at the discretion of the Club Manager.

DIRECT DEBIT – OVERDUE ACCOUNTS

  • All entitlements and entry into any club may be revoked if your account is in arrears and you fail to resolve the debt after being provided reasonable notice.
  • Any reversals will incur a $14.95 reversal fee, charged on the next payment.
  • If you fail to pay us the fees by the due date, we are entitled to refuse you entry to the Club.
  • If unpaid fees remain outstanding and after attempts by us to rectify the arrears, your membership may be forwarded to a collection agency for further action.

Transfers

  • Member who are within the minimum term of their agreement and cannot fulfil their minimum term may transfer their membership to another person.
  • A $99 transfer fee and a $15 establishment fee apply to all transfers.
  • The transferee (new member) will take over the remaining payments of the current contact.
  • Members must present themselves and the transferee to YFC reception to make the payment and complete the change of membership.
  • After the new contract has been submitted, the old, transferred membership will be cancelled with no further payments.

Upfront memberships

Cancellations

  • Memberships cannot be cancelled before the expiry date.
  • You may terminate your membership before the expiry date upon presentation of a medical certificate only and is at the discretion of the Club Manager. Any refunds or costs incurred is at the discretion of the Club Manager.

Suspensions

  • Memberships cannot be suspended, and expiry dates cannot be extended for any reason.
  • You may suspend your membership before the expiry date upon presentation of a medical certificate only and is at the discretion of the Club Manager.

Transfers

  • Transfers are available at a cost of $99 if a member cannot fulfil the total period of the upfront membership.
  • Members must present themselves and the transferee to YFC reception to make the payment and complete the change of membership. The transferee will take-over the membership for the remainder of the membership period.

Lifestyle membershiP

Benefits associated with the Lifestyle Membership are only for the owner of the card and may not be transferred. Lifestyle Membership holders are entitled to unlimited use of the following facilities as described below:

 

Gladstone, CALLIOPE, and Boyne Tannum Golf: Membership holders must present their identification card and swipe card for verification before playing golf. All players must report to the Pro Shop before teeing off and sign in. All Lifestyle Members must obey the Golf Club rules.

 

Gladstone Cinemas: Lifestyle members are required to present to the designated register at the Candy bar and swipe their Lifestyle card where they will be presented with a movie ticket which must be presented to the usher before entering. These tickets do not include any special events, Movie Premieres, Movie Marathons, Film Festivals or Gold Room passes.

 

Fitness Centre Membership: All members must swipe their membership card when entering any Fitness centre. Access will be denied without identification card. Membership covers gym, aerobics, change-rooms etc however does not include child-minding services and personal training or programming.

 

Gladstone Aquatic Centre: Lifestyle members must present their identification card and swipe card for verification before entering the facility; Follow all directions of staff and signage.

 

Gladstone Tennis & Squash: Lifestyle members must present their identification card and swipe card for verification before entering the facility; Follow all directions of staff and signage.
